2 narco smugglers acquitted

JAMMU, Nov 21: Principal Sessions Judge Bhaderwah, M K Sharma has acquitted Ishtiaq Ahmad, son of Abdul Rehman Gojal and Abdul Latief Bhat, son of Shamas-ud-Din Bhat, who were facing trial in NDPS case.
These accused persons were arrested by Bhaderwah Police on July 31, 2010 and from their possession more than one kilogram of heroin was recovered.
After hearing both the sides, Principal Sessions Judge Bhaderwah observed, “the Investigating Officer has intentionally and deliberately breached the provisions of Section 55”, adding “non-compliance of such a provision deliberately and intentionally must be viewed with suspicion”.
The Court held that the prosecution has not complied with the requirements of law while conducting investigation which has not only caused prejudice to the accused but cast doubt on the prosecution story.
Accordingly, the Court acquitted the accused of the charges leveled against him.
