JAMMU, Sept 10: Principal Sessions Judge Kargil, Tahir Khurshid Raina today rejected the bail application of a woman who was involved in a murder case.
According to the police case, applicant Zahra Batool in connivance with another accused committed a murder on July 29, 2012 and accordingly they were booked under Section 302 RPC. The applicant—Zahra Batool, who is in judicial custody, moved bail application on the ground that she was unnecessarily trapped in the case by the prosecution.
After hearing arguments of counsels of applicant and the prosecution, Principal Sessions Judge observed, “as per the medical opinion the deceased was firstly put into unconscious state by giving medicine and thereafter strangulated to death”, adding “the entire circumstantial evidence points towards the connivance of applicant for committing the offence”
“In the instant case, a young man, who was the sole bread winner and a Government servant has been done to unnatural death by the accused and her co-accused”, the court said, adding “Article 21 of the Constitution which talks of right to life and liberty gets curtailed of a person whom he or she is an accused of an illegal act whereby life and liberty of someone else stands infringed”.
With these observations, court rejected the bail application of the accused.
