JAMMU, Jan 29: In a special leave petition challenging the order of grant of pre-arrest bail to former Health Minister Shabir Ahmad Khan in the alleged sexual assault case, Bench of Supreme Court comprising Justice Dipak Mishra and Justice Prafulla C Pant after hearing Senior Advocate Sunil Sethi for the Shabir Khan, upheld the order of J&K High Court for granting bail.
When the matter was taken-up for hearing, Apex Court observed, “we have been apprised that the chargesheet has been filed against the accused-respondents and after taking into consideration that the investigation is complete and the chargesheet has been filed, we are not inclined to set aside the impugned order, whereby Shabir Ahmed Khan has been extended the benefit of Section 497A of J&K CrPC and for offence punishable under Section 354 read with Section 509 of Ranbir Penal Code.”
SC further stated that as the chargesheet has been filed and directed the trial Court to proceed in accordance with law and disposed of SLP.
