The Supreme Court has issued a landmark order directing the Centre and the States as well as all departments and PSUs to reserve three per cent jobs for the physically handicapped persons. The Court said that it was unfortunate that these persons were socially discriminated against and that they were denied the opportunity of serving themselves and the society. The order states that not observing the directive of the court would mean non-obedience and action against the nodal officer was to be invoked. Incidentally, the Court observed that the three per cent quota reserved for the physically disabled will not be affected by not more than 50 per cent reservation formula.
Supreme Court’s humanitarian approach to the issue is laudable and we warmly welcome the order. The blind, deaf, dumb and palsy stricken people come under the purview of the Apex Court order. They are living in a state of abject poverty and destitution and the society has not been sympathetic to them. The court order will bring cheer to these unfortunate people especially when the court wants to ensure that its order is implemented at all costs. Physical disability should not become the reason for denying them the right to work and right to decent living. The Court has invoked Article 33 of the Constitution and supported the reservation decision on that basis. Incidentally the advocate fighting the case on behalf of the disabled was himself a disabled person.
