This has reference to news item “Govt to hold census of OBC’s for reservation” published in DE Nov. 23.
On the face of the step taken by the Govt. it appears that it is only a delaying tactics coupled with ulterior motives to gain benefit in the coming elections. After 22 years, the State Govt. has contemplated a move to conduct the census of people belonging to Other Backward Communities/Classes in the State to grant them the benefit of reservations as per the Mandal Commission recommendations. The State Govt has failed so far to do justice and deprived the OBCs of their share in reservation from last 22 years till date, which means that at least one generation of the OBCs has been deprived of their legitimate share/right.
27 percent reservation is guaranteed right of the OBCs as the Mandal Commission recommendations provides for 27 percent reservation to OBC’s and the recommendations has been upheld by the Constitutional Bench of the Supreme Court headed by the then Chief Justice of India. The judgement of the Supreme Court was pronounced on 16.11.1992 but upto this date the peoples belonging to the OBC’s in the State of J&K have not got the fruits of the judgment and this is the only State in India which has so far not implemented the recommendations of the Mandal Commission. Therefore, in view of the aforesaid position and fact that other communities have been given reservation in the State without any caste based census i.e. SC and STs and therefore without adopting delaying tactics, the State Government should grant 27 percent reservation in favour of OBCs,otherwise contemplating a new process, i.e. survey of the population of the OBC’s after 22 years is basically a delay tactics.
