Prosecution failure leads to acquittal of brown sugar smugglers

JAMMU, Dec 20: Principal Sessions Judge Jammu, Kartar Singh has acquitted two accused namely Javed Iqbal, son of Mohd Maqbool Wani and Asmat Ullah Bhat, son of Hafiz Ullah Bhat, both the residents of Lal Chowk Srinagar, who were facing trial in alleged smuggling of brown sugar as prosecution miserably failed to prove its case.
According to the police case, on September 10, 2006, Gandhi Nagar Police intercepted a Maruti car bearing registration No 3670/JK02L and recovered 1.25 kilograms of brown sugar from the accused persons.
After hearing both the sides, Principal Sessions Judge observed, “the evidence produced by the prosecution clearly establishes that mandatory provisions of law have not been complied with and it has rendered the prosecution story doubtful”.
Stating that prosecution has miserably failed to prove the case beyond reasonable shadow of doubt, the Court acquitted the accused of the charges framed against them.
