Prosecution failure leads to acquittal in rape case

JAMMU, Aug 8: Principal Sessions Judge Reasi Kamlesh Pandita has acquitted Karan Singh, son of Jodh Singh of Bhamagh in Reasi district, who was facing trial in a rape case, as prosecution failed to prove the case.
After hearing both the sides, the court observed, “it is trite that there is no rule of law that the testimony of the prosecutrix requires corroboration in material particulars”, adding “if in a particular case the court finds it difficult to accept the version of the prosecutrix, it may look for evidence which may lend assurance short of corroboration to her testimony”.
“In the facts of the case, this court finds it difficult to accept the version of the prosecutrix which is not only highly improbable rather suggest that it is the product of falsehood at every step”, Principal Sessions Judge said, adding “consequently the statement of prosecutrix is not reliable”.
As prosecution failed to prove the charges against the accused, the court acquitted the accused of the charges under Sections 376, 342 of the RPC.
