Proprietor of Pvt firm, GMC officials booked

JAMMU, Sept 25: Crime Branch today registered a case against proprietor of M/s Nigam KG Associates and members of Purchase Committee of the Government Medical College for causing huge loss to the State exchequer by committing cheating and forgery.
A spokesman of the Crime Branch said that a complaint regarding cheating and forgery lodged by M/s L M Agencies, Srinagar before the Surgical and Scientific Traders Association, Gandhi Nagar was forwarded to the Crime Headquarters by general secretary of the Association.
In the complaint, it has been mentioned that Government Medical College, Jammu issued a tender notice for providing equipment with the condition that the original manufacturer must have turnover of Rs 15 crore. M/s Nigam KG Associates, 185 Sector- 7 Channi Himmat got the tender approved in their favour by producing fake/fictitious document of original manufacturer— M/s S S Technomed (P) Ltd Delhi showing their turn over as Rs 15 crore whereas actual turnover of the manufacturer was Rs 1.16 crore only.
It has also been mentioned in the complaint that last year the firm also got their tender approved on the basis of tampered documents and wife of present Member Secretary of the Purchase Committee constituted by the Government Medical College, Jammu was a sleeping partner of M/s Nigam KG Associates, who helped the firm in obtaining the tenders and thereby caused huge loss to the State exchequer.
On receipt of complaint, an enquiry was initiated in Crime Branch during which it came to fore that while submitting the tender, M/s Nigam KG Associates enclosed a turn-over certificate of M/s S S Technomed (P) Ltd, Delhi, which is a manufacturing unit of the product, showing turnover of Rs 16,85,34,834 issued by M/s Savadi and Associates, Chartered Accountant, Pune, while as the balance sheet report for the year ending 31st March 2010 indicated the turn-over of M/s S S Technomed (P) Ltd.Delhi as Rs 1,05,36,909.
It was also found that the certificate of M/s S S Technomed (P) Ltd, Delhi, annexed with the tender was fake and fabricated and was not issued by M/s Savadi & Associates, Chartered Accountant, Pune. Further as per the approval, supply order was placed for three vaporizers with Anaesthesia Machine Model Elite-615, whereas the firm supplied only two such vaporizers that too without any certification of FDA (Food and Drug Administration) or CE (Certificate of Excellence), which was a mandatory requirement.
During further course of enquiry, it was found that accused Nigam Gupta, Proprietor M/s Nigam KG Associates in connivance with the members of the Purchase Committee No 2, constituted by the Government Medical College, Jammu got the tender approved in his favour on the basis of a forged and fake document and members of the Purchase Committee in sheer abuse of their official position facilitated the commission of crime and caused huge loss to the State exchequer.
Accordingly, a formal case has been registered in Police Station Crime Branch, Jammu under Sections 420, 465, 467, 468, 471, 120-B RPC read with Section 5(2) Prevention of Corruption Act, 2006 against Nigam Gupta, Proprietor M/s Nigam KG Associates 185 Sector- 7, Channi Himmat and members of the Purchase Committee for commission of crime.
