NIA gets 15-day remand of Magray

JAMMU, Feb 29: In the much publicized Pulwama terror attack in which 40 CRPF personnel had attained martyrdom, Special Judge NIA Subash C Gupta has granted 15 days police remand of Shakir Bashir Magray to National Investigation Agency.
Moving an application seeking custody of the accused, Rakesh Balwal, Superintendent of Police, NIA submitted that the accused was arrested on 28.02.2020 at Srinagar and his custodial interrogation is needed for taking the investigation of the case to its logical conclusion.
On perusal and consideration of the relevant entries of the CD file, the Special Judge NIA observed, “initially a case FIR No 20/2019 dated 14.2.2019 was registered with the P/S Awantipora for commission of offences under Section 302,307 of RPC & Sections 16,18 & 20 UA(P) Act and Section 3 of Explosive Substance Act”, adding “subsequently, in compliance to the Order No. 11011/07/2019/NIA dated 19.2.2019, issued by the Ministry of Home Affairs, NIA Branch Office Jammu has re-registered a case No. RC-02/2019 /NIA/JMU dated 20.2.2019 and thereafter immediately set the investigation into motion”.
“Accused was arrested for his role in the criminal conspiracy. Keeping in view the facts and the circumstances of the case, gravity and heinousness of the crime, submissions made by the CIO and the stage of the investigation of the case, the court is of the considered view that the custodial interrogation of the accused is imperative to facilitate the ongoing investigation & to take it to logical conclusion”, the Judge further observed.
Accordingly, court remanded the accused to 15 days police custody.
