After perusal of the CD files, Special Judge NIA observed, “the investigation of the case is scattered across various places of J&K and more persons are involved in conspiracy which needs to be verified”, adding “some of the co-accused are still absconding which is causing difficulties in unearthing the larger conspiracy behind the attack on BSF convoy”.

Upon this, Special Judge NIA observed, “as per the law laid down by the Apex Court accused cannot be kept in cell in ordinarily course that too when they are on judicial remand”. Accordingly, court directed Superintendent Kot-Bhalwal Jail that he should not keep the accused in cell as alleged by the accused.
