Man accused of kidnapping, raping divorced wife acquitted

JAMMU, Aug 17: Principal Sessions Judge Kathua, M K Hanjura has acquitted Sohan Singh alias Kala, who was facing trial in alleged kidnapping and rape with his divorced wife.
According to the police case, Sohan Singh, his father Rattan Singh and Prem Singh, son of Pritam Singh of Pathankot barged into the house of Rani Devi, daughter of Chajju Ram of Jagatpur Kathua in furtherance of a common intention to abduct her.
On seeing the accused, Rani Devi fled from the spot and took refuge in the house of Roop Singh living in her contiguity. The accused pushed their way into the house of Roop Singh and abducted Rani Devi.
They took her to their house situated at Kalanoor, Gurdaspur where the accused Sohan Singh against whom a decree of divorce had been passed by the court, raped her. The  occurrence was reported to the Lakhanpur Police and accordingly a case for offences under Sections 364/452/323/149/149 RPC was registered. After completion of investigation challan was presented in the court of law.
After hearing both the sides, Principal Sessions Judge Kathua, M K Hanjura observed, “the recovery appears only to be a tale. Two independent witnesses have demolished the structure of the alleged recovery of the prosecutrix from the house of the accused”, adding “prosecution has not presented its case in a manner beyond any shadow of doubt. The link evidence in the case is missing”.
Stating that prosecution has failed to connect the accused with the crime, the Court acquitted him of the charges leveled against him.
