Law pass-outs demand issuance of Provisional Enrolment Certificate

Write to Chief Justice, seek her intervention

SRINAGAR, Sept 23: The law pass outs of the year 2019 today wrote to Chief Justice of High Court, Gita Mittal seeking her intervention in the matter of the issuance of Provisional Enrolment Certificate so that they can appear in All India Bar Exam 2020 being conducted by Bar Council of India.
The law practitioners have written to the CJ for her intervention into the matter so that their Certificates are issued before October 17 this year.
“We may respectfully submit that we had finished our last semester of B.A.LLB & LLB in the year 2019 with a desire to get enrolled shortly. On 5th August 2019 Parliament amended Article 370 and subsequently bifurcated the state of Jammu & Kashmir which led to a communication blackout,” the letter written to the CJ reads.
“The other reason for the delay was Darbar Move, from Srinagar to Jammu, when the administration of High Court shifted to Jammu and we had to wait till it moves back. The enrollment process was further delayed by the COVID 19 pandemic whereby lockdown was imposed for more than 4 months in Kashmir,” the letter stated.
It is pertinent to mention here that the BCI is conducting this year AIBE XV on 8th November 2020 but the registration closes only on 17th October 2020.
The BCI conducts AIBE every year and the candidates who qualify in AIBE are awarded Certificate of Practice (COP) by BCI, which enables them to practice in a court of law in India.
“If we fail to get provisional Certificate of enrollment from J&K High court before 17th October, we will be ineligible to apply, which will shrink us by another year to appear in much awaited AIBE,” the letter written to CJ read.
Notably, in Jammu and Kashmir, the Bar Council comes under High court and is headed by the Chief Justice.
The pass-outs have completed the filing process of documents for enrolment and are waiting for the Provisional Enrolment Certificate.
The pass-outs have requested the CJ to direct the concerned authorities to expedite the issuance of Enrolment certificates in their favour before 17th October 2020.
