SRINAGAR, Dec 10: Special Judge Anti-Corruption Srinagar today rejected the bail plea of one of the accused in the Jammu and Kashmir Board of Professional Entrance Exams (JKBOPEE) Common Entrance Test- 2012 scam and said that this is the fittest case where jail, not bail is the remedy.
Special Judge Anti-Corruption, Mohan Lal Manhas, while rejecting the bail plea of Sajjad Ahmad Bhat, who is one of the accused in the CET-2012 scam, observed: “…I am of the opinion that this is the fittest case where the bail ought not to be granted, and the stage is not ripe, therefore, the investigating agency must get more time to collect evidence and detect the clandestine mega sale of question papers of Common Entrance Test of J&K Board of Professional Entrance Examination (BOPEE). Hence the bail is refused. The application is rejected and dismissed. Bail application is disposed off, and after due completion under rules, shall be consigned to records.”
The Judge on the basis of the arguments of the Counsel of Bhat and Crime Branch said: “…I therefore hold that this is the fittest case where jail and not bail is the appropriate remedy. Moreover the judgments relied upon by the Counsel for the applicant/accused don’t lay down an invariable law that whenever an application for bail is produced in a non-bailable offence, the court should invariably grant bail to the accused without making any inquiry about the nature of the evidence, the likelihood of its punishment and its severity etc.”
The Crime Branch Counsel during the arguments pleaded that the BOPEE scandal in which Sajjad is involved is a mega one and the general public and students have lost faith on BOPEE.
Crime Branch while pleading for rejection of bail before the court said that more disclosures are awaited from Sajjad that could lead to recovery of money and identification of more beneficiaries of the scam.
The Crime Branch plea for rejection of bail was that Sajjad along with other accused including former BOPEE chairman Mushtaq Ahmad Peer and Farooq Itoo are involved in the leaking of the question papers of CET-2012 this marring the carrier of merit holding candidates.
He told the court that Sajjad has received Physics, Chemistry and Biology question papers of CET-2012 from one Farooq Ahmad Itoo at Nishat and distributed it to candidates by charging them lakhs of rupees through one Haroon Rashid.
It may be mentioned here that former BOPEE chairman Peer is the main accused in the case and he has been sent to Central Jail by the court last week. Court is hearing his bail plea but has not granted him bail so far. After rejection of Sajjad’s bail, the chances of Peer getting bail are grim as he is the main accused in the case while Sajjad is a broker.
