Industrial units get extension in validity of provisional registration

JAMMU, Dec 20: In two significant orders, the Department of Industries and Commerce, Jammu and Kashmir, today granted extension in validity of Provisional Registration of units which have not commenced production within the stipulated time frame and also notified that all the Societies registered under the erstwhile J&K Societies Registration Act 1998, which have not applied for re-registration under the Central Societies Registration Act 1860, stand de-registered.
To get extension in validity of Provisional Registration of the Industrial units, the stakeholders have to complete the requisite formalities within 15 days, otherwise the allotted leased land to them shall be retrieved.
Individual affidavit, duly attested by a Magistrate is required to be furnished by these unit holders to the General Manager of concerned District Industries Centre committing to operationalize the production by the extended date i.e. 30th June 2022.
In case the affidavit is not filed within 15 days from today, the allotment shall be deemed to have been cancelled and the leased land shall be retrieved by the respective Corporation(s), without any notice.
The decision to grant one time extension in the validity of Provisional Registration of units, which have failed to commence production within the stipulated time frame, was taken by the Apex Projects Clearance Committee, in its meeting held on December 8, 2021 and the Directorates of Industries and Commerce today issued formal notification in this regard.
With the issuance of the formal notification, a genuine demand of the new industrial units in Jammu and Kashmir has been conceded by the Government. These new industrial units could not start production within the stipulated time frame of three years because of the Covid pandemic situation since March 2020 and earlier circumstances in the wake of August 5, 2019 developments.
As per the J&K Industrial Policy 2016, a new Industrial units must come into production within three years of its Provisional Registration for getting Permanent Registration.
Meanwhile, according to a separate notification by the Registrar of Societies/Firms, Directorate of Industries and Commerce, all the Societies registered under the erstwhile J&K Societies Registration Act 1998, which have not applied for re-registration under the Societies Registration Act 1860, are deemed to have been de-registered with immediate effect.
However, the said entities shall be accountable for liabilities attributed to them.
Pertinent to mention that the J&K Societies Registration Act, 1998 (Samvat)-1941 AD was repealed and the corresponding Central Societies Registration Act 1860 was made applicable as per the Jammu and Kashmir Re-organization Act 2019.
Thereafter, as per the Administrative Department’s order number IND/DIC-169/2007 dated 19-04-2021, all the societies registered before 31-10-2019 under the erstwhile J&K Societies Registration Act 1998, were required to get re-registered under the Societies Registration Act 1860. Accordingly, all these societies were intimated, through public notices from April 20, 2021 to December 7, 2021, for submission of the requisite documents for re-registration till December 18, 2021, which was the last date for the same.
