Imprisonment to 3 for thrashing officials

Srinagar, Oct 15: A local Court today awarded one year imprisonment to three men who thrashed Fire and Emergency staff and damaged a Fire Tender in a village in Central Kashmir district of Budgam ago.
The court of Judicial Magistrate Budgam presided by Imtiyaz Ahmad Lone convicted three accused person for committing offences U/S 353,336 and 427 of Ranbir Penal Code and awarded them one year imprisonment.
The three persons have been found guilty by the court for thrashing Fire and Emergency staff and damaging a Fire Tender in village Watred Khan Sahib in Central Kashmir district of Budgam where they had gone to extinguish fire.
On December 11, 2009 fire broke out at Watred Khan Sahib in district Budgam and on receiving the massage the fire tenders reached the spot within no time.  Some miscreants among the mob gathered in the village and attacked the Fire tender and the crew by pelting stones and attacking with with lathis. They damaged the fire tender and manhandled the staff as a result of which hurdles were created in putting off the fire.
Police swung into action and an FIR vide No. 548/2009 under Sections 353, 336, 427 RPC was registered and investigation of the case was carried out. The accused were chargesheeted on 22.5.2010.
Given the reference of criminal law justice court said: “The courts of law are meant to see that no innocent is punished and of course it is also to be seen that no guilty goes Scot free” and awarded sentence to three persons involved in the offences.
“Accused persons shall undergo imprisonment of  one year for the commission of offence made punishable under Section 353 RPC and a fine of Rs 1000 in default of deposit of fine persons accused shall serve further imprisonment of 2 months”, court said.
“Accused persons shall undergo imprisonment of 3 months for the commission of offence made punishable under Section 336 RPC”, court said.
“Accused persons shall undergo imprisonment of one year for the commission of offences made punishable under Section 427 RPC and a fine of Rs 1000  in default of deposit of fine persons accused shall serve further imprisonment of   2 months”, court said these punishments shall run concurrently.
