Huge pendency in NDPSA cases

This is with reference to news “ Over 2100 NDPSA cases pending in J&K as HC’s communiqués fall on deaf ears”(refer DE 3rd April 2016).It has been reported that a total of 2173 cases registered under NDPS Act are pending in J&K . District Anantnag stands first as 357 cases are pending in the district whereas District Jammu stands at 3rd position where 269 such cases are pending. It is being experienced daily that at least 1-2 cases of drug peddlers are reported in the news papers.  It is agreed that huge number of drug peddlers and narcotics smugglers are being arrested by the police every year but few are punished as large number of them are acquitted from the courts due to improper investigation. Thus, there is alarming rise in drug trafficking in the State. Generally drugs are supplied to the youth of this state resulting in poisoning of their lives. It is pertinent to mention that the youth is considered as the future of any nation and if youth in large number would indulge in the drug addiction then it could be imagined that what would be the fate of our nation.
Supreme Court of the country had passed directions to establish Special Courts in consultation with State High Court in January 2013 to deal exclusively with the offences registered under the NDPS Act. Directions were also issued by the Registrar General of J&K High Court to the Department of Law, Justice and Parliamentary Affairs of the state in the year 2013 for strict compliance. But in spite of issuance of repeated reminders to the Law Department and responding all queries raised in the matter since July 2013, no Special Courts have been established till date. No doubt our State is facing financial crisis as even the dearness relief payable w.e.f July 2015 has not been paid to the employees as well as to the pensioners but this cannot be a valid reason for non establishment of Special Courts for expeditious disposal of cases registered under NDPS Act.
It is, therefore, requested to State Administrative Committee/Govt that in the interest of public in general and youth in particular, Special Courts as desired by the Supreme Court of the country may be established immediately so that cases registered under NDPS Act are disposed of expeditiously and drug peddlers/smugglers are punished as early as possible.
