HC’s directive to DC Kishtwar

JAMMU, Feb 24: In a petition regarding alleged killing of a youth by Special Investigation Team, High Court today directed Deputy Commissioner Kishtwar to file report or appear in person.
The petition was filed by father of a young boy, who was allegedly killed in police custody after being shown as Pakistani militant.
After hearing Advocate SS Ahmed appearing for the petitioner whereas Mohd Saleem GA vice AAG HA Siddiqui for the State, Justice Bansi Lal Bhat observed, “by virtue of order dated November 18, 2013 Deputy Commissioner Kishtwar was directed that while taking a decision he shall keep in the mind the particular aspect of the matter as to whether DNA profiling is necessary to come to a proper conclusions but counsel for the state has not been able to place on record any material to show that such decision has been taken”.
“The matter is lingering on only on account of inaction on the part of Deputy Commissioner Kishtwar”, High Court said and issued notice to him to report about the decision taken within a period of two weeks failing which he shall appear in person on next date of hearing to explain his position.
