JAMMU, Feb 26: In bunch of contempt petitions in premature retirement cases, High Court has directed Secretaries of General Administration and Law Departments to submit compliance report failing which appropriate action will be taken for willful disobedience of the orders.
After hearing battery of lawyers for the petitioners whereas Senior AAG Seema Shekhar for the State, Justice Alok Aradhe observed, “on February 5, 2018 it was submitted before this court on behalf of the respondents that in case the high level committee decides not to file the SLP, the decision of this court shall be implemented”.
“On this submission, this court had granted a week’s time to the respondents to submit the compliance report while making it clear that in case of non-compliance Commissioner Secretary of General Administration Department, Administrative Secretaries of the concerned departments and Secretary, Department of Law shall remain present before this court positively”, Justice Aradhe further observed.
“Being aggrieved of this order, the respondents filed an appeal before the Division Bench, which issued notice and kept in abeyance the order requiring the presence of batch of officials on 13.02.2018”, Justice Aradhe said, adding “it was also directed by the DB that if the directions of the Single Judge are not carried out till 23.02.2018, the officials who are required to be present by virtue of the impugned order, shall be present before the Single Judge”.
In compliance of the order passed by this court on 05.02.2018 and as directed by Division Bench vide order dated 12.02.2018, the Secretary, Department of Law and Commissioner Secretary, General Administrative Department are present before this court, Justice Aradhe further said.
“The concerned respondents are directed to grant all consequential benefits to the petitioners within a period of two months from today and compliance report be filed before the Registrar Judicial within one week thereafter. In case the compliance report is not filed by the respondents the Registrar Judicial shall place the matter before this court for necessary orders”, Justice Aradhe said, adding “in case of further non-compliance this court shall be constrained to take appropriate action against the respondents for willful disobedience of the order passed by this court including framing of Robkar against them”.
Senior Advocates B S Salathia, D C Raina and Sunil Sethi and Advocate Abhinav Sharma appeared for the petitioners while as Senior AAG Seema Shekhar appeared for the respondents.
