SRINAGAR, Sept 8: High Court today suspended the sentence awarded to the murder accused and directed the authorities to release them on bail till further orders from the court.
Justice MH Attar while allowing the bail application of the accused persons, who are in jail in a murder case, stayed the sentence and directed the authorities to release them subject to bail bond to the tune of Rs 5000.
Court said that respondents (police authorities) have not chosen to file objections to oppose the bail application of accused as on last date of hearing while extending time to respondents for filing objection, court had observed that in case objections are not filed then application for suspension for sentence and grant of bail shall be taken up for consideration.
Appearing counsel for accused persons submitted before the court that since the appellants and other ten persons were charged for allegedly committed offence u/S 302 (murder) along with other Section of CrPC the trial court after conclusion of trial exonerated ten and convicted the appellants for having committed offence u/S 304(attempt to murder) and have been awarded 10 years in prison.
