HC stays proceedings in corruption case against CE, foreigner

JAMMU, Feb 4: In a much publicized trap case in which Zahoor Hussain Zargar Chief Engineer Mechanical Engineering Deptt Jammu, Ranjan Kumar Langer AEE Mechanical Engineering Deptt Jammu, one foreigner namely Hanho Yoon @ Calvin Yoon of South Korea MD M/s CAS India Pvt Ltd Gurgaon, Anil Dhar DGM M/s CAS India Pvt Ltd was arrested by the VOJ and presented challan and charges framed.
Against the order of the trial court for framing charges, foreigner namely Hanho Yoon @ Calvin Yoon of South Korea MD M/s CAS India Pvt Ltd Gurgaon, Anil Dhar DGM M/s CAS India Pvt Ltd filed petition in the State High Court.
Justice Bansi Lal Bhat of J&K High Court Jammu Wing after hearing Sr Adv Sunil Sethi with Adv Ravi Abrol appearing for the petitioner observed that it is contended that despite the trial court coming to the conclusion that no illegality was committed by the accused Zahoor Hussain Zargar Chief Engineer while awarding contract to M/s CAS Weighing India Private Limited, the trial Court proceeded to frame charges against the petitioners for offence u/s 5(1) d r/w Section 5(2) Prevention of Corruption Act and 161, 165-1 and 12-B RPC and it is contended that there was no material on record even to suggest that supply order was withheld with criminal intention of deriving any undue pecuniary benefit, issued notice returnable within three weeks and meanwhile ordered that proceedings before the Trial Court shall remain stayed.
