HC stays JMC order regarding cancellation of allotment to NGO

JAMMU, July 25: High Court has stayed the order of the Jammu Municipal Corporation (JMC) regarding cancellation of allotment to Non-Governmental Organization (NGO) namely Association for Socio-Economic Education & Environment Development (Association for SEED).
The counsel for the petitioner submitted that allotment has been cancelled without giving any opportunity of being heard and neither served any show cause notice.
Justice Sindhu Sharma ordered, “subject to objections and till next date before the bench, the order dated 23.06.2021 shall remain stayed”.
Advocate Ankur Sharma & Chetan Prabhakar appeared for the petitioner while Senior AAG SS Nanda appeared for the UT of J&K and others.
The petitioner filed the Writ Petition against an order of termination dated 23-06-2021 by which the respondents have unilaterally and without any authority and in a discreet and unlawful manner terminated the services of the petitioner by back dating the show cause notice dated 03-06-2021 to punish the petitioner for filing an RTI dated 18-06-2021 seeking details regarding labour compliances, payment details to other NGOs and criteria/procedure adopted for work allocation.
The notice was issued to M/s Association for Socio-Economics & Environmental Development (Ajaat Jamwal) but no address was mentioned.
