HC seeks record of Dr Shashi’s promotion

JAMMU, Sept 17: In a petition filed by Dr Indu Koul seeking direction to State not to promote Dr Shashi Gupta, presently Incharge Principal Government Medical College Jammu, High Court today directed Secretary Health and Medical Education to furnish information about the steps taken by the Government on the decision of PSC dated June 21, 2013.
He was further directed to make available the record pertaining to the promotion of Dr Shashi Gupta as Assistant Professor and Registrar Judicial was directed to keep the record in his custody and submit on the next date of hearing.
After hearing Senior Advocate U K Jalali with Advocate Anuj Sawhney appearing for the petitioner whereas Neeru Goswami, Deputy AG for the State, Senior Advocate DC Raina assisted by Advocate FA Natnoo for the PSC, Senior Advocate M K Bhardwaj assisted by Advocate Vasu Dubey and Advocate WS Nargal for the private respondent, Justice A M Magrey observed, “perusal of the record produced by Advocate F A Natnoo reveals that Public Service Commission after examination of the record has come to its conclusion that there seems some manipulation which has been concealed by the Government in subsequent meetings while considering case of respondent No.5 for promotion”.
“It has also been made clear by Commission that promotion in respect of respondent-5 has been cleared only from April 23, 1995 and the Government has given benefit to her from April 23, 1994 in violation of the mandate of the recommendations”, the High Court further observed.
“Let the Government file response to the decision of the Commission on affidavit and explain as to under which provision promotion of respondent No. 5 has been ante-dated from a date not cleared by the Commission. Before proceeding further it has become necessary for the Secretary Health and Medical Education Department to file response to the Commission’s decision as also to the observations of this Court”.
“Secretary Health and Medical Education Department is at liberty to proceed in the matter and have a preliminary enquiry conducted regarding observations of the Commission as also of the Court so as to furnish report on the next date of hearing”, Justice Magrey said, adding “Secretary shall also make available the record pertaining to the promotion of Dr Shashi Gupta as Assistant Professor and the Registrar Judicial shall keep the record in his custody and submit on the next date of hearing along with file.
The High Court also directed the Department to furnish details about the steps taken by the Government on the receipt of decision of the Commission dated June 21, 2013.
