HC seeks affidavit from Law Dept on creation of posts in computer section

Srinagar, Apr 21: High Court has directed the Secretary Law, Justice and Parliamentary Affairs to file an affidavit indicating therein the decision taken by him with regard to creation of various posts already recommended by the court for the computer section.
The direction followed after the stand taken by the Secretary concerned that for want of certain formalities, the proposal for creation of posts in the computer section of the court could not be considered. In this connection a communication was placed before the court which indicates that a meeting was convened April 19 in the office of Financial Commissioner, Finance to discuss the issue so that the final decision be taken.
However the outcome of the meeting was not placed before the court. In this view, the Division Bench of Justice Sanjeev Kumar and Justice Javed Iqbal granted further time to Secretary Law to file a fresh affidavit indicating the decision taken by him with regard to the creation of posts in question which have already recommended by the court.
It is seven employees who were appointed as Data Entry Operators in Srinagar wing of High Court filed a petition seeking therein creation of four posts of Selection Grade Data Entry Operators, two posts of Section Officer (Computer), two posts of Assistant Registrar-I and one post of Assistant Registrar-II so that they would be entitled for fair chance of promotion.
They pray that the authorities be directed to remove the stagnation of the petitioners by creating promotional avenues on the analogy as has been evolved in the cases of other categories of posts in the court.
Since the Full Court has already made its recommendation in the matter and the Law Department for about to take final call on the issue and the same till date has not been done on part of the department concern leaving no option for the court but to call the Commissioner Secretary in case he fails to file his response by or before April 20.
As per the present status of the posts which are available in Computer Section of the court, there are bleak chances of promotional avenues to the Data Entry Operators of Srinagar wing even though certain creations were made by the authorities but as per the petitioners those are not sufficient resulting into depriving them from future promotions.
The non-action on part of the respondent-department in re-organizing the computer section as also not creating sufficient promotional posts so that the stagnation of petitioners could have been removed forced them to knock the portals of the court in order to redress their genuine and legitimate grievances.
