HC rejects bail in misappropriation of more than Rs 2 cr in ATM case

JAMMU, July 30: State High Court rejected the bail application of Suresh Kumar, Sunil Kumar, Pawan Kumar son of Nek Ram and Pawan Kumar son of Des Raj who were allegedly involved in ATM theft case.
According to the police report, on May 18, 2016, complainant Jatinder Singh, Senior Manager, Jammu, Radiant Cash Management Service Pvt. Ltd. filed a written report with regard to misappropriation of cash from SBI ATMs, Udhampur and averring that the company office is situated at Hall No.6, Sector No.2, Channi Himmat, Jammu and during the cash audit and verification on May 17, 2016, it came out physical cash shortage in the 15 ATMs (details given of the ATMs given in the application) to the tune of Rs. 25277900/-.
Further details of two custodian responsible for all cash operation and handling ATMs on this route were Sahil Sharma and Vicky Kumar. On receipt of this application, FIR No. 153/2016 for offence u/s 409/403/120-B RPC was registered in police station Udhampur.
Justice Tashi Rabstan after hearing both the sides observed that Challan to be produced before the Court of Chief Judicial Magistrate, Udhampur, in my view it would not be appropriate and in the fitness of things to deal with this application at this stage.
Therefore, it would be appropriate if the petitioners are directed to approach before the trial Court for grant of regular bail. So far as the allegation of criminal conspiracy under Section 120-B of RPC is concerned, the petitioners would be at liberty to address the said issue before the trial Court. With these observations court rejected the bail application.
