Srinagar, Dec 5: High Court today quashed two detention orders under Public Safety Act and directed the authorities to release them preventive custody forthwith.
Justice Ali Mohammad Magrey while quashing the detention order passed by District Magistrate Shopian on August 8 last year against Waseem Ahmad Sheikh of Shopian, said the order of detention is vitiated as the detenu has not been supplied the material to which the detaining authority relied up and directed he be released from the preventive custody.
Court directed the Registrar Judicial to forthwith convey the release order to District Magistrate concerned as also to Jail Superintendent for compliance of the court directions forthwith.
In other case, Jutice Puneet Gupta quashed the detention order passed by District Magistrate Baramulla against one Jehangir Reshi and directed the authorities to release him if not required in any other case.
Justice Gupta said the petitioner has not been provided all the necessary material on the basis of which the order of detention was passed as such the impugned detention is illegal in the eyes of law. “The order of detention, impugned in the present petition is liable to be quashed and is, accordingly, quashed. The petitioner if not presently required in any other case be released forthwith”, Justice Gupta directed.
