HC orders status-quo on AC’s transfer

JAMMU, Oct 29: High Court today ordered status quo on transfer of Assistant Commissioner Jammu.
Assistant Commissioner Suram Chand Sharma was transferred vide Govt Order No 290- RD&PR dated October 21, 2014 to the post of Project Officer (WS) Reasi within a week of his posting as ACD Jammu vide Govt Order No 1058-GAD of 2014 dated October 16, 2014.
The petitioner submitted that  his transfer was premature and violative of Transfer Policy duly notified vide Govt. Order No. 861-GAD of 2010 dated 28-07-2010.
“The premature transfer is actuated by malafide for the simple reason that Commissioner Secretary Rural Development Department failed to provide the reasons and grounds which necessitated his premature transfer”, submitted Advocates Hunur Gupta and Dewakar Sharma appearing for the petitioner.
After hearing counsels for the petitioner, Justice Janak Raj Kotwal observed, “impugned transfer order of the petitioner is premature”. Accordingly, High Court issued notice to the State and others and in the meanwhile ordered that subject to objections and till next date before the Bench, status-quo as regards present place of petitioner—ACD Jammu shall be maintained.
