JAMMU, Dec 31: In a contempt petition filed by Shahnaz Akthar, High Court has issued notice to the Chief Secretary and Commissioner Secretaries of GAD and Industry and Commerce Departments.
After hearing Advocate Irfaan Khan for the petitioner, Justice Mohammad Yaqoob Mir directed respondents to file statement of the facts as well as compliance report by or before the next date-February 10, 2014.
The petitioner has sought initiation of contempt proceedings against the respondents for willful/intentional defiance of judgment dated February 4, 2013 passed in SWP No. 2875/2010 titled Shahnaz Akthar Versus State & Ors.
The petitioner had filed the a writ petition before the High Court seeking direction to the respondent—Commissioner/Secretary Industry and Commerce Department to include the name of the petitioner in the final seniority list of the Project Manager in the Industry and Commerce Department which was notified vide Government Order No. 185-IND of 2008 dated 10-07-2008 under ST category.
She had also sought relief by way of directions to the Commissioner/ Secretary Industry and Commerce Department to delete the name of the petitioner from the seniority list of the Functional Managers as the petitioner was never appointed/ adjusted against the post of Functional Manager and neither worked against the post. The petitioner had further sought relief for her induction in the Kashmir Administrative Services (KAS) with effect from 22-07-2008 under ST category with all the consequential benefits.
The High Court vide judgment dated 04-02-2013 had directed the respondents to include the name of the petitioner in the final list of the Project Manager after deleting her name from the final seniority list of Functional Manager and induct her in Kashmir Administrative Service.
