SRINAGAR, Nov 3: Division Bench of State High Court comprising Justice Mohammad Yaqoob Mir and Justice Ali Mohammad Magrey today granted three weeks time to Centre with the rider that no further time be granted for filing of response regarding providing of financial assistance to State Government for the infrastructure and rehabilitation of flood victims of 2014.
The time was granted after Union Counsel S A Makroo (ASGI) submitted that the matter is under active consideration with Home and Planning Departments as such suitable time be granted.
“Granted. It is made clear that on such count, no further extension of time be granted”, said the DB while granting three weeks time to the counsel and directed the listing of matter on November 11 for further consideration.
Court during the proceedings of the matter asked appearing counsel that “rise with the situation and already one year has lapsed with taking of time to meet the demands”.
Court for the time being exempted the personal appearance of Secretary, Ministry of Finance, and Government of India. He (Secretary) was directed to be present before the court to explain the delay in providing pending liability out of Rs 44000 crore as claimed by the then State Government for floods rehabilitation.
It is worthwhile to mention here that out of Rs 44, 000 crore only Rs 1602 crore have been released so for as per the stand of State Government and on the other hand Union Government claims that Rs 5000 crore have been released so far.
In a connected matter filed by High Court for release of estimated amount of damages to the infrastructure of High Court including library which as per the communication of Registrar General of the High Court to State as well as Union Government is about Rs 11 crore, DB granted three weeks time for filing of response.
Counsel for High Court advocate Javed Iqbal submitted before the court that no response is being given by the other side as such appearance of some official be directed before the court on next date to explain the delay.
Court after these submissions granted three weeks time as last and final opportunity for filing of reply.
