SRINAGAR, Mar 5: The High Court today directed for nomination of Judicial Magistrates for Juvenile Justice Boards (JJBs) so that these boards are made functional at an earliest.
The direction was passed after the court was informed that sanction was accorded to the creation of 8 posts of Magistrates for the 8 JJBs, which are to be constituted in district Anantnag, Baramulla, Srinagar, Jammu, Doda, Rajouri, Kargil and Leh in the first phase after notifying the jurisdiction of these boards.
Division Bench of Chief Justice Badar Durrez Ahmad and Justice Ali Mohammad Magrey said this after the information provided by the State as well as counsel appearing on behalf of the court, said the next step has to be taken for the High Court to nominate Judicial Magistrates to head each of the JJBs and directed the Government to notify the same thereafter in terms of the section as provided in the JJB Act.
The Division Bench in this connection directed the Registrar General of the Court to put up the proposal for such nomination of the eligible Magistrates in terms of said act before the Court and after nomination of Magistrates, Court directed the Government shall notify the constitution of the board without any delay so that the JJB can become functional at the earliest.
DB with regard to the setting up of CWCs in all the 22 districts, said, it is already noted the selection-cum-oversight committee completed the process and on behalf of State advocate B A Dar informed the Court that the recommendation has already been made. Keeping in view of the statement made by the state counsel DB directed the Government to notify the same.
With regard to the action plan for care, support and rehabilitation to unclaimed and abandoned children no compliance has been submitted till date as such final opportunity to file the plan of action with regard to the said issue has been granted to the authorities today. Similarly the authorities were required to file the status report with regard to registration of Children Homes for the entire J&K that has also not been done. Court directed the same shall be done positively within two weeks.
