HC dismisses MHA appeal on CRPF officer’s demotion

Srinagar, Sept 13: The Division Bench of High Court today dismissed the appeal of Union of India against a Single Bench order that had kept in abeyance the demotion order of former Inspector General of Central Reserve Police Force (CRPF) issued by Ministry of Home Affairs in March this year.
The Division Bench of High Court comprising Chief Justice M M Kumar and Justice D S Thakur dismissed the appeal filed by the Ministry of Home Affairs, New Delhi by observing that the appellant is to pursue the matter before Single Bench.
Earlier in April this year, Justice Muhammad Yaqoob Mir admitted the writ petition filed by the former Inspector of CRPF, S S Sandhu challenging the demotion order issued by the Ministry of Home Affairs.
The Division Bench order said: “We dismiss the appeal leaving it open to the appellant through MHA to pursue the application for vacation of stay order which is pending before the learned Single Bench.”
While dismissing the appeal the Bench observed: “Having heard learned counsel for appellant, we are of the view that once the application for stay order has been filed, then the present appeal on the same cause of action would not be maintainable.”
However, the Division Bench observed that the Single Bench should dispose off the matter expeditiously preferable within a period of two months.
