JAMMU, July 19: High Court today dismissed a petition filed by former MLC Ravinder Sharma challenging notice issued by the Estates Department seeking his eviction from Government quarter under Jammu and Kashmir Public Premises (Eviction of un-authorized occupants) Act and held that a person who doesn’t hold any post cannot take umbrage under an unwarranted plea.
After hearing both the sides, Justice M K Hanjura observed, “it is not clear as to why and how the former MLC wants to retain the quarter. Our State has limited sources in terms of Government accommodation and even in most deserving cases such requests are generally refused”.
“This man takes shelter under the plea of security when as per his contention he has been provided adequate one. He does not hold any post at the moment except for hankering after the post. A person who does not hold any post cannot take umbrage under an unwarranted plea”, High Court said while dismissing the application.
Justice Hanjura further observed, “in a good number of cases the execution of the eviction notices has been stayed by the orders of the court. Under these circumstances, it will be appropriate if these matters sub judice in the Jammu and the Srinagar Wings of the High Court are listed before the court for consideration as the State Government pays a huge chunk of money to hire private accommodation for the employees and other functionaries as a consequence of which the poor man’s money, which could have been used to generate the basic necessities of the common people, goes down the drain”.
High Court asked Registrar General to place a copy of this order before the Chief Justice for soliciting further directions.
