HC dismisses application seeking release of JeI Chief

Srinagar, Sept 2: High Court today dismissed the application of Jamat-e-Islami Chief (Ameer-e-Jamaat) seeing his release on parole in view of his daughter’s marriage and directed for making arrangement to watch the marriage ceremony through video conferencing.
The application has been filed by petitioner seeking release of detenu on parole enabling him to attend marriage ceremony of his daughter from 2nd to 4th September 2020.
Government counsel stated before the court of Justice Tashi Rabstan that a representation was submitted by wife of Hameed Ganie (detenu) to the Government for release of detenu on parole.
He has produced a copy of communication bearing No. CID/BR/H-02/2019/BUD/ 1476 dated 31st August 2020. Perusal whereof reveals that a representation, filed by detenue’s wife for release of his husband on parole, has not been considered.
“In view of above, application on hand is rejected”, court concluded.
However, Court directed the Superintendent, District Jail, Kathua, to make arrangements to enable the detenu to watch the marriage ceremony of his daughter on 3rd September 2020 through virtual  mode, WhatsApp mode or any other mode that would be available to the concerned authorities.
Court asked the detenue’s counsel to provide telephone number(s) to  Senior AAG, today itself, so that he is in a position to forward the same to concerned authorities for making the above arrangements.
