JAMMU, July 4: In blatant violation of the judgment of Constitutional Bench of the Supreme Court, State Vigilance Organization is sleeping over several corruption related complaints during the past quite long time that too without any lawful justification and in a contempt petition filed in this regard by Prof SK Bhalla, today Justice Tashi Rabstan of J&K High Court Jammu Wing after considering the statement of facts and the latest status report filed by Director Vigilance Sheikh Owais Ahmed expressed its dis-satisfaction particularly in a complaint against Dr Nutan Kumar Resutra the then Principal Govt Degree College Rajouri presently Nodal Principal GGM Science College Jammu as in the statement of facts the SVO admitted that in the purchase and installation of wi-fi in the college campus Rajouri, it was found that same was done on the basis of repeat order made by Principal SPMR College and the installation was approved by Principal and there was no such proposal. In this work, it was found that for three items exorbitant rates have been paid, which has caused loss of Rs 73060 to the State exchequer.
However, SVO instead of registering FIR in the matter referred the matter to the Government for initiating a regular departmental action against Dr Nutan Kumar Resutra then Principal Govt Degree College Rajouri.
During the course of arguments Advocate Sheikh Shakeel Ahmed submitted that undue favour was given to the concerned Principal as he is highly influential and close to the corridors of power and the SVO converted a fool-proof case of corruption into departmental enquiry when loss to the State exchequer had been fully established. Adv SS Ahmed impressed upon the Court to summon the Director Vigilance to explain his conduct in the matter. On the other hand Sr. AAG Gagan Basotra appearing for the SVO justified the departmental action and submitted that every type of loss to the exchequer does not become an offence under prevention of corruption act. Adv SS Ahmed also drew the attention of the Court towards the closure of the complaint with regard to alleged illegal/backdoor appointments in the Assembly Secretariat and further submitted that the said complaint was closed on the basis of a report received from the Assembly Secretariat. He requested the Court that the said report of the Assembly Secretariat be produced for the perusal of the Court.
Upon this Justice Tashi Rabstan issued directions to the Director SVO to file latest status/ Action Taken Report with regard to Dr Nutan Kumar Resutra on the next date of hearing and also directed the Director SVO to produce the record of the report received from the assembly secretariat on the basis of which the complaint dated March 4, 2014 has been closed. Looking into the importance of the case, High Court directed Registry to list this contempt petition immediately after two weeks.
