HC directs removal of illegal constructions, encroachments in Gulmarg

Srinagar, Nov 26: The High Court today directed for immediate action to remove illegal constructions and encroachments from world famous ski resort of Gulmarg after Court Commissioner submitted her report on illegal constructions.
Court was hearing an application on illegal construction under the garb of repairs in Gulmarg and directed the Registrar Judicial of the Court to visit on spot to verify the authenticity of news report and submit her report before the court with regard to illegal constructions in the resort. The Court took notice of the ‘Daily Excelsior’ news report and treated it as an application.
The report filed by the Registrar Judicial revealed that illegal constructions, encroachments as also deviations by the owners of the hotel, hutments and Government departments. The Division Bench of Chief Justice Gita Mittal and Justice Sanjeev Kumar directed immediate action is required to be taken.
The DB directed the Registry to serve the copy of the RJ’s report to SHO Gulmarg for action. Court directed the report be also served to the owners of those whose structures have been found to be raised in contravention of building permissions for their response of being heard before initiating actions against them.
Court has also directed the Registrar Judicial to ensure that all the matters pertaining to Gulmarg be clubbed and listed along with the PIL relating the protections and conservation of Gulmarg on November 28.
Registrar Judicial in her report submitted about Khillan Hut that three storeyed concrete building by excavating outside the borderline of plinth about 5 feet for hotel has been constructed secretly by covering it with tin sheets on all sides as earlier the said structure comprised two storeyed only as such the owners has violated the GDA order.
With regard to Green Tree Hut, the State counsel informed the court that it has completely raised on State land and FIR has been registered against the persons who have raised the illegal constructions and investigation is going on.
About the Police Hut, the report said that the structure was also earlier visited and concrete wall was being constructed in sheer violation of court directions. Likewise Hotel Rosewood was raising the cantilever without permission of the competent authority.
“On spot visit to Hotel Pine View, repairment work was going on, but without permission of the court or BOCA”, read the report of Registrar Judicial.
Apart from these constructions, structures of Special Forest Division Tangmarg and Fisheries Department have been found to be raised without any permission from the competent authority.
