SRINAGAR, July 22: The High Court today directed the Home Department to file fresh affidavit in tune with the directions passed on June 30 with regard to ex-gratia relief to those 16 persons who were excluded by the State Government with the opinion that they do not fall in unrest 2010.
The Division Bench of the court comprising Justice Mohammad Yaqoob Mir and Justice Hasnain Masoodi said that the affidavit filed is “not in conformity” with the directions issued on June 30.
Admitting that the cases of 16 persons who were excluded from 2010 unrest by the State Government, Principal Home secretary in his affidavit submitted that the names of the deceased persons who have died between the period January 1, 2010 to December 31, 2010 due to causes of civil disturbances shall be placed before the designated committee in the Home Department for consideration of grant of special ex-gratia provided by the Central Government.
Earlier the court had rejected the “cut of date” as June 2010 to September 2010 fixed by the Government with regard to killings during 2010 unrest and had asked the Government the cases are required to be segregated by granting ex-gratia relief to those who have been killed between January to December 2010(excluding period from June 2010 to September 2010).
Advocate Showkat Makroo representing Central Government stated that once State Government writes to the Central Government for grant of ex-gratia relief to the deserving persons, the same shall be accepted and the suitable grant be released.
Advocate RA Khan submitted that in principle the decision has been taken and it will take weeks time for finalizing the same. Court granted him to weeks for this exercise and directed him to file the fresh affidavit by next date of hearing.
