HC directs Govt to free Handwara girl, family

Srinagar, May 12: The State High Court today while disposing of the petition of alleged Handwara molestation case directed the Government to free the family of victim girl along with their family from police protection.
The direction has been passed after the undertaking filed by the parents of the girl stating therein that they do not need any police protection or protective custody any more. “It being so, they along with their daughter and her aunt shall be free to go where ever they want”, said the Division Bench of Justice Mohammad Yaqoob Mir and Justice Ali Mohammad Magrey while deciding the petition of mother of minor girl.
Court while considering the all aspects like submissions of petitioner’s counsel, objections filed by both Army and State Government said there is no question of illegal detention or confinement arises. “Such contention is unjustified and uncalled for”, judgment of DB reads.
Parents of the girl on asking by the court filed undertaking in the court indicating therein that they do not need any police protection or protective custody any more. “We do not seek any restrictions, regulations or surveillance of our movements by any agency”, says the parents in their undertaking.
It may be mentioned here that the father of the girl had also moved application before the court of Chief Judicial Magistrate for police protection and thereafter another application was moved by him to the CJM court for withdrawing of protection. CJM court had rejected the request for withdrawing of police protection by observing that since the cases are pending before the High Court as such cannot pass any order and accordingly dismissed the application.
A petition was filed before the High Court by the mother of victim girl immediately the incident of alleged molestation by Army personnel to a school going girl which evoked strong protests across the Valley resulting into killing of 5 civilians including an aged woman last month.
It was further submited that they do not require any police protection or protective custody and  wish to move freely and reside at any place of their  choose. “I declare, that the contents of this affidavit are true and correct lo the best of my personal knowledge”, father of the minor girls says.
