Srinagar, Feb 6: Jammu and Kashmir High Court today directed the Central Government to pay ex-gratia to the kith and kin of left out persons who were killed during 2010 unrest in the Valley.
The Division Bench comprising Justice MH Attar and Justice J R Kotwal directed the Government to pay ex gratia to the kith and kin of other additional 7 persons who were killed in 2010 unrest.
Assistant Solicitor General of India Showkat Makroo stated before the court that since the State Government had made recommendation in respect of particular number of families and persons who were to be paid the compensation amount.
“Respondents are duty bound to pay the ex gratia to other additional person or kith and kin or claimants in view of the court order passed on June 6, 2013”, directed the bench.
Makroo after direction from the court that respondents are duty bound to pay ex gratia to these 7 victims also, stated that due to financial implications they could not pay the amount as ex gratia to these 7 victims and the Ministry of Home Affairs is examining the matter in consultation with the Ministry of Finance, Department of expenditure.
The ASGI further stated that funds are not available at this stage and it is for the reason that the matter has been taken up with the Ministry of Finance.
Court granted him four weeks time for payment of compensation to the kith and kin of these additional 7 persons.
These seven persons were excluded from the list of those who got killed in 2010 unrest on the opinion that they were killed prior to June 2010 as such do not fall in 2010 unrest.
Earlier, court had rejected the ‘cut of date’ as June 2010 to September 2010 fixed by the State Government with regard to killings during 2010 unrest and had asked the Government that the cases are required to be segregated by granting ex-gratia relief to those who have been killed between January to December 2010(excluding period from June 2010 to September 2010).
Makroo representing Central Government had stated that once State Government writes to the Central Government for grant of ex-gratia relief to the deserving persons, the same shall be accepted and the suitable grant be released.
