HC directs AAG to produce entire record

JAMMU, Sept 4: In a petition challenging cancellation of State Subjects of 136 persons, High Court has issued notice to the State through Commissioner Secretary Revenue Department Commission of Inquiry and sought the entire record on next date of hearing.
The cancellation of State Subjects has been challenged by Dev Anand Kalra through Advocates A K Sawhney and Aseem Sawhney on the ground that the impugned Government Order No.101- Rev (PRC) of 2015 dated 25.06.2015 passed by the Commissioner Secretary, Revenue Department violates the legal and fundamental rights of the petitioner as the same was issued without affording the petitioner any opportunity to be heard.
“So much so the respondents have not even provided the petitioner with a copy of this harsh and punitive order”, the counsels for the petitioner submitted, adding “even the Rules with regard to grant and cancellation of Permanent Resident Certificates have not been followed  in the instant case”.
On hearing the submissions of counsels for the petitioner, Justice Tashi Rabstan issued notice to the respondents and Additional Advocate General Ahsan Mirza waived notice for the State.
