HC directive to GDA on encroachments

SRINAGAR, Apr 11:  Jammu and Kashmir High Court today directed Gulmarg Development Authority to retrieve the encroached land from the illegal occupants immediately with the assistance of Police and get it fenced.
In order to save the famous tourist resort Gulmarg from encroachment, the Division Bench directed the Government to provide funds to GDA for safeguarding the beautiful environment of the world famous tourist resort.
“The CEO GDA is further directed to conclude without any further delay, the process of retrieving the land, which is in illegal occupation of encroachers and DIG Police North Circle, shall provide police assistance to the CEO GDA wherever is required by the GDA”, directed the division bench of Justice MH Attar and Justice Ali Mohammad Magrey.
Court also directed GDA to take all necessary measures for enclosing the retrieved land which till date has been obtained from the illegal occupation of encroachers and further ensure that the State land which has been retrieved is not encroached by any one again.
“This direction is issued, as stated by the GDA counsel that the areas have already been demarcated, to ensure that the persons in whose favour the lease, in respect of immoveable property is subsisting as on date do not encroach upon the State land”, court said.
The court directed the hoteliers, who are in authorized possession of lease land, to get their area fenced with wooden fencing in presence of GDA and revenue authorities.
Meanwhile, Deputy Commissioner Baramulla in compliance of the court directions passed earlier to him stated that ‘court order has been implemented on spot’ and land measuring 8 kanals and 15 marlas have been taken back after proper demarcation and handed over to Tehsildar Gulmarg on Superdari.
The CEO GDA giving the details of action taken against encroachers and unauthorized occupants informed the court that notices have been issued to the illegal occupants of State land and in some of the cases authorities (GDA) has passed orders of taking over the possession of land and in some cases action could not be taken as the illegal occupants have got orders from the court.
