Sir,
This has reference to the news item in DE for establishment of first ever law commission in J&K. It is indeed unfortunate that the only state in India having its own constitution did not have a law commission of its own. Law commission being an advisory body with govt. plays a very important role in reforming law for maximizing justice in society and promoting good governance under the rule of law. Further, it is the obligation of the commission to review/repeal the obsolete law, examine the existing laws and recommend to the govt its view on any subject relating to law and judicial administration.
But it is quite shocking to hear that the file for constituting the first law commission is shuttling between the finance dept and the law dept because of lack of finance and manpower. Presently, there is 20th law commission with justice D K jain as its chairman is working in our country, but as for as our state is concerned it is quite painful that no such commission has yet been constituted. Thus it is expected that both departments would sit together to resolve the issue and pave the way for the establishment of first ever law commission in our state.
