Employees Compensation Act not applicable to industrial units: BBIA

JAMMU, Nov 17: Bari Brahmana Industrial Associa-tion (BBIA) has claimed that Employees Compensation Act 1923 is not applicable to industrial units in the State.
An urgent meeting of the members of the Bari Brahmana Industries Association, Jammu was held today under the chairmanship of Lalit Mahajan president BBIA in  presence of  Suresh Mahajan,  senior vice president,  Varun Singla vice president,  Ajay Langer  general secretary,  Vivek Singhal – secretary and  Viraaj Malhotra- treasurer BBIA and other members to discuss advertisement published in today’s newspaper in respect of Employees Compensation Act 1923.
Members present in the meeting discussed the issue in respect of advertisement published in today’s newspaper given by J&K Labour Department in respect of Employees Compensation Act 1923 which has created confusion amongst the Unit holders as it is not applicable to Industrial Units covered under the ESI Act.
It was further resolved during the course of discussions that as per the ESI Act the ESIC Corporation is responsible to compensate any employee /worker who sustains injury resulting into partial/ total disablement or any occupational disease arising out of and during the course of his /her employment or dies during the course of his/her employment with in the industrial unit covered under ESI Act & such unit holder is not bound to pay any compensation.
The BBIA  urged upon the Labour Commissioner, J&K  to  notify that the Employees Compensation Act 1923 is not applicable to industrial units covered under ESI Act to remove the confusion created with it and resolve the issue.
