Don’t misinterpret SC observation on Guru : Dr Jitendra

JAMMU, Apr 8: Dissuading the separatist leadership as well as separatist friendly Kashmiri-centric political parties and leaders from misleading the people by misinterpreting the content and spirit of Supreme Court order of April 6 staying the execution of 8 persons, Dr Jitendra Singh, BJP State Chief Spokesperson & National Executive Member, sought to put the record straight by stating here today that a careful study of the judgement passed by Justice P Sathasivam and Justice M Y Eqbal makes it abundantly clear that nowhere have the Hon’ble Judges made any observation against the hanging of Afzal Guru.
Dr Jitendra Singh said that the comment made by the Court with regard to Afzal Guru is a mere ‘‘procedural’’ comment wherein the Hon’ble Judges observed that the intimation about execution of Afzal Guru should not have reached his family after his hanging and that this should not happen in other similar cases. He said the Kashmir based politicians including those belonging to the ruling National Conference (NC) are infact committing a contempt of court by misinterpreting the Supreme Court order and manipulating the same to present as if the court had endorsed the unconstitutional stand taken by certain NC leaders that Guru’s execution was “selective’’ or carried out without giving him an opportunity to go through the full judicial process.
As regards ordering stay for four weeks on execution of 8 persons whose mercy pleas had been rejected by the President, Dr Jitendra Singh explained that the Hon’ble Judges had taken cognizance of Advocate Colin Gonsalves’ argument that delay in carrying out death sentence and adjudicating mercy pleas in all these cases ranged from 3 to 12 years and therefore there could be a ground for seeking commutation of death penalty to life imprisonment. The stay order simply intended to allow time for discussing the merits of Advocate Gonsalves’ argument and in no way can be construed as a dissenting observation against earlier court order of execution against these 8 persons or the Parliament attack convict Afzal Guru, he added.
Dr Jitendra Singh warned that the politicians who are trying to raise the Afzal Guru bogey following April 6 Supreme Court judgement are infact playing a dangerous game of divisive politics through appeasement of anti-India elements in the Valley.
