Srinagar, Mar 17: High Court today set aside the transfer order of a doctor who was posted as Medical Superintendent (MS) in Bandirpora district hospital on a non-existent post with the direction to the authorities to allow the doctor to work as Incharge CMO Bandipora.
By observing that transfer is an exigency of service as such ordinarily the courts do not interfere with administrative matters having reference to posting and transfers of Government employees, HC said, “but where power with respect to posting of employees is exercised in ‘arbitrary and unfair means’ the court has at times shown indulgence.”
Court said that the doctor has been transferred and posted as the MS in District Hospital Bandipora by the authorities which post in fact as per the submission of counsel appearing on behalf of Health Department is non-existent.
Dr Bilquees was holding the post of in charge CMO in district Bandipora and was transferred and posted as MS district hospital Bandipora vide order No.723-HME of 2015 dated: 29.10.2015.
