JAMMU, Feb 1: In a Public Interest Litigation (PIL) filed by Advocate Sumit Nayyar seeking development of tourist infrastructural facilities at Patnitop, Mantalai and Sudh Mahadev, Division Bench of State High Court comprising Chief Justice Gita Mittal and Justice Tashi Rabstan today directed respondents to file latest position with regard to the permission for construction of Convention Centre at Patnitop.
When the PIL came-up for hearing, Division Bench observed, “pursuant to our order dated 27th December, 2018, a status report stands filed by Secretary to Government, Tourism Department thereby informing us that 112th meeting of the Forest Advisory Committee was held under the chairmanship of the Chief Secretary wherein the issue of permitting the use of 0.175 hectares of forest land for construction of Convention Centre at Patnitop was taken up for consideration”.
“The minutes of the meeting and the status report refers to orders passed in IA No. 401 in case No.202/1995 titled Godvarman Vs. Union of India by the Supreme Court which records the statement of Advocate General that no further construction or conversion will be permitted at Patnitop. In view of this, the proposal stands deferred”, the DB observed, adding “the Forest Advisory Committee has proposed to file an application seeking permission of the Supreme Court to construct the Convention Centre at Patnitop”.
