JAMMU, Feb 28: Division Bench of the State High Court comprising Chief Justice Bader Durrez Ahmed and Justice Sanjeev Kumar today issued notices to Commissioner Secretary General Administration Department, Commissioner Secretary Animal Husbandry Department and Divisional Commissioners in a contempt petition.
The contempt petition has been filed by SAVE (Save Animal Value Environment), an NGO working for welfare of animals through its Chairperson Devinder Kaur Madaan alias Rumpy Madaan for willful defiance of judgment dated October 11, 2017 passed by the Division Bench whereby directions had been issued for constitution of Societies for Prevention of Cruelty of Animals in State of Jammu and Kashmir.
When the contempt petition came up for hearing, Advocate Sheikh Shakeel Ahmed with Advocates Suraj Singh and Supriya Chouhan submitted that in Jammu Division District Societies have been constituted in all 10 districts but the societies have not been registered under the J&K Registration of Societies Act and on the other hand the similar societies have not been constituted for Kashmir Province as well as for Ladakh Region.
“Despite the expiry of more than four months there is no headway in the matter and the petitioner NGO also served a reminder upon the officials on January 29, 2018 for compliance of the directions but till date the District Societies for Prevention of Cruelty to Animals have not been constituted with respect to Kashmir and Ladakh Region”, Advocate Ahmed said.
After considering the submissions of Advocate Ahmed, the Division Bench issued notices to Khursheed Ahmed Shah, Commissioner Secretary General Administration Department, Raj Kumar Bhagat, Commissioner Secretary Animal Husbandry Department, Baseer Khan, Divisional Commissioner Kashmir and Hemant Kumar Sharma, Divisional Commissioner Jammu.
The notices were accepted in the open court by AAG Rohit Kapoor, who was granted time to file the statement of facts/compliance report on or before April 16, 2018.
