DB issues notices to CS, Div Coms, DCs

JAMMU, Nov 11: In a Public Interest Litigation (PIL) challenging Jammu and Kashmir State Lands (Vesting of Ownership to the Occupants) Act popularly known as Roshni Scheme, Division Bench of State High Court comprising Chief Justice MM Kumar and Justice Tashi Rabstan today issued notice to the Chief Secretary, Secretary Law and Revenue Departments, Divisional Commissioners and all the 22 Deputy Commissioners.
They were directed to file reply to the PIL within four weeks. Additional Advocate General, Ravinder Sharma vice Senior AAG Gagan Basotra accepted notices for the Chief Secretary and Law Secretary while as AAG H A Saddiqui accepted notices on behalf of Revenue Secretary, Divisional Commissioners and Deputy Commissioners.
The petitioner Ankur Sharma, who was appearing in person, said that the legislation was conceived to reward the violators of law, who instead of being booked for grabbing the State land were conferred with the ownership rights.
“The law being a unique piece of legislation on the statue book cannot be allowed to sustain in an organized society governed by Rule of Law and it being against public policy and constitutional mandate is required to be declared unconstitutional/ultra-vires and the land so regularized in favour of the illegal occupants is required to be retrieved by setting aside all orders of regularizations”, he submitted.
