DB holds petitioner entitled for free BDS seat, compensation

JAMMU, Apr 11:  Division Bench of High Court comprising Chief Justice MM Kumar and Justice Muzaffar Hussain Attar has dismissed an appeal filed by the BOPEE against the judgement of Writ Court regarding free seat of BDS. The DB has also held the respondent Sunandani Sharma entitled for free seat of BDS with compensation of Rs 1 lakh from the BOPEE.
After hearing Senior Advocate PN Raina with Advocate JA Hamal and Advocate Meharban Singh for the appellants whereas Deputy AG Neeru Goswami for the State and Advocate Abhinav Sharma for the Sunandani Sharma, the DB directed BOPEE to issue necessary notification for grant of admission to Sunandani Sharma-writ petitioner/ respondent in the college within one week. The DB further directed Indira Gandhi Govt Dental College Jammu to admit Sunandani Sharma within one week time from the issuance of notification by the BOPEE.
Division Bench further directed Dental Council of India to arrange additional classes for Sunandani Sharma and take all necessary steps in accordance with rules, so as to enable her to appear in all examinations. The DB, however, made it clear that though Sunandani Sharma is admitted against the available/vacant, which has become available in the year 2013-14 for making her eligible to appear in the examination she can be permitted to take supplementary examination or examination with the students who may be selected in the session 2014-15 by the BOPEE.
Division Bench modified the direction to the extent that Sunandani Sharma shall be given compensation of Rs 1 lakh instead of Rs 2 lakh.
