JAMMU, Aug 28: In a petition filed by Joginder Singh, Bench Secretary of the High Court regarding dearth of staff at various levels in High Court and District Courts, Pay Anomaly in respect of officers and staff and promotional avenues to Law Graduate Readers of the High Court, Division Bench of State High Court comprising Justice Dhiraj Singh Thakur and Justice Sindhu Sharma today granted last and final opportunity of two weeks to State for complying with the order dated July 31, 2018.
On July 31, 2018, Division Bench had directed the respondents to file the separate affidavits, indicating therein as to what steps had been taken with regard to 09 agenda items, which were discussed in the meeting held on 20.03.2018 in the office chamber of the Registrar General of the High Court.
Joginder Singh, who appeared in person, submitted that the progress shown with regard to the agenda Nos. 1 to 8 is satisfactory. However, with regard to the agenda item No. 9, the view adopted by the Government related to the issue of removal of pay anomaly by the Pay Anomaly Committee is erroneous.
It was urged that the issue was not so much with regard to the removal of pay anomaly between the J&K High Court Staff inter se, as much as it was pertaining to bringing the staff at par with the staff of other High Courts like Delhi and Punjab & Haryana High Court.
DB observed, “the Registrar General already appears to have conveyed a communication dated 28.12.2017 to the Secretary to Government, Department of Law, Justice & Parliamentary Affairs with regard to the scales of pay being enjoyed by the employees of other High Courts. In addition to that, Registrar General also appears to have sent another communication dated 21.07.2018, clarifying therein the factual position with regard to the pay scales of the employees of the High Court of Delhi & Punjab and Haryana”.
“Let an appropriate decision be taken by the Government in terms of communication dated 28.12.2017 read with communication dated 21.07.2018 and the result thereof be conveyed to this office positively on or before the next date of hearing”, the DB said and directed respondents to submit a detailed status report with regard to the further action taken with regard to agenda item Nos. 1 to 8 on the next date.
