JAMMU, Dec 20: Division Bench of the State High Court comprising Chief Justice Badar Durrez Ahmed and Justice Sanjeev Kumar has dismissed the criminal acquittal appeal filed by the State against the judgment delivered by the Sessions Judge, Udhampur whereby all the six accused were acquitted in a murder case.
After hearing Government Advocate Ahatsham Bhat appearing for the State and Advocate Rahul Raina appearing for the six accused, the DB observed, “after examining the totality of circumstances and considering the arguments advanced by the counsel for the parties and also upon going through the evidence in detail, we are of the view that there is no cause for interfering with the judgment of acquittal rendered by the Trial Court”.
“No perversity has been pointed out in the manner of appreciation of evidence by the Sessions Court. It is also not the case that any relevant evidence has been ignored by the Trial Court”, the DB said while dismissing the appeal.
