Petition challenging transfer of forest land to HC

JAMMU, Dec 13: In a petition filed by Ghulam Mohammad and orders seeking quashment of the Government Order pertaining to the transfer of forest land to the High Court for development of judicial infrastructure, Division Bench comprising Chief Justice Pankaj Mithal and Justice Sanjay Dhar has directed all the respondents to file comprehensive counter affidavit within a period of six weeks.
During the course of hearing, Advocate Shah Mohammad Choudhary appearing for the petitioners submitted that under the provisions of the Scheduled Tribes and Other Traditional Forest Dwellers (Recognition of Forest Rights) Act, 2006, rights in the property have accrued to the petitioners who claim to be the Tribals living on the forest land and, therefore, the land occupied by them cannot be used for any other purpose but for their habitation.
